SELF DECLARATION OF ACTUAL OCCUPANTS

By this office circulars bearing No.EM/AS-6/SLP/1252, 1621, 6996 & 10155 dtd 27.04.2005, 22.05.2006, 2.11.2006 & 18.1.2007 respectively, all registered tenants/lessees were requested to furnish the enumeration of actual occupants on Port Trust premises in the format enclosed therewith for proper implementation of the Hon'ble Supreme Court Judgement dtd 13.01.2004. 

2.         It is observed that the above information has not been furnished in many cases despite clear indication that the same was required to be furnished immediately and during the month of January every year. 

3.         The Board of Trustees of the Port of Mumbai had earlier decided that the failure to furnish the self-declaration will attract penalty of 3 months revised rent/ compensation, calculated based on 6% per annum return on the rates prescribed in the Stamp Duty Ready Reckoner for every year of delay. 

4.         The above decision has been reviewed by the  Board of Trustees of the Port of Mumbai and it has now been decided that time till 30.6.2008 be granted to all those who have not submitted lists of actual occupants in 2006 as well as in January 2007 and 2008, and that in case of parties who have already submitted the self-declarations, the delay will be condoned.  Failure to submit the self-declarations before 30.6.2008 will attract penalty of one month's revised rent/ compensation calculated based on 6% per annum return on rates prescribed in the Ready Reckoner for every year of delay. 

5.         All registered tenants/lessees of Mumbai Port Trust are therefore, once again requested to furnish the self-declaration of actual occupants on Port Trust premises in the format (enclosed for ready reference) duly signed by registered tenants/lessees by 30.6.2008 and also during the month of January every year without fail.
