Internal Procedure for dealing with the requests
Steps :
(i) Submission of application
(ii) Intimation letter from CPIO about amount of further fees to be paid | Tariff
(iii) Payment of further fees | Tariff
(iv) Furnishing of information by CPIO
(v) Appeal to the First Appellate Authority against decisions of CPIO
(vi) Orders passed by First Appellate Authority
(vii) Appeal to Central Information Commission
Checklist for application :
(i) Application on plain paper preferably as per format mentioned at Annexure A
(ii) Application Fee (Demand Draft / Banker’s Cheque / Indian Postal Order / Original receipt of payment if paid in cash)
(iii) Documentary proof if an applicant is ‘below poverty line’
Checklist for appeal :
(i) Self-attested copies of the RTI Application, submitted to the CPIO, Order/s or decision or response, if any, against which the appeal is being preferred;
(ii) Copies of documents relied upon by the appellant and referred to in the appeal;
(iii) A certificate stating that the matter under appeal or complaint have not been previously filed or are pending with any court or tribunal or with any other authority;
(iv) An index of the documents referred to in the appeal; and
(v) A list of dates briefly indicating in chronological order the progress of the matter upto the date of filing the appeal.
Processing Duration:
(A) Chief Public Information Officer
(i) Ordinarily, it is 30 days from the date of receipt of the application by the PIO [Section 7(1)]
(ii) In cases of information concerning the life and liberty of a person, it is merely 48 hours
(iii) In case the application for information is given to APIO, 5 days shall be added to the above response time making it 35 days [Section 5(2)]
(iv) If the interests of third party are involved, then time limit shall be 40 days (maximum period of 30 days plus 10 days time given to the party to make representation) [Section 11(3)]
(v) It is 45 days for human rights violation information from security and intelligence agencies under Second Schedule to the Act or notified by the State Governments [Section 24(4)]
(B) First Appellate Authority
The Appellate Authority shall dispose off the appeal within a period of 30 days or in exceptional cases within 45 days of the receipt of appeal.
